Introduction to Labour and Industrial Law Book Description About the Book: in view of new work arrangements and global competition, labour laws are required to be amended and given a new shape. Since the first edition in 2002 some Acts have been amended and in some of them changes have been proposed but still they are far from what is required. It has been proposed to permit nightshifts for women workers under the Factories Act, 1948 but the Bill is still pending. Self-certification and Amnesty Schemes are proposed by the Employees State Insurance Corporation under the ESI Act. A number of important Supreme Court decisions have appeared. All these things necessitated the new edition. In order to make the list of Labour Laws complete, some more Acts have been included in the new edition, namely, Fatal Accidents Act, 1855, the Industrial Employment (Standing Orders) Act, 1946, the Maternity Benefit Act, 1961, the Apprentices Act, 1961, the Equal Remuneration Act, 1976, the Child Labour (Prohibition and Regulation) Act, 1986, and the Contract Labour (Regulation and Abolition) Act, 1970. A simplified version has been attempted for easy understanding. Commentaries on Acts which were already there in the book have also been re-written. The Supreme Court has observed that whether a person is a workman or not depends upon the nature of his duties, principal duty assigned to him in particular and not necessarily on designation. Section 33(2)(b) of the Industrial Disputes Act, 1948, has been held by the Supreme Court to be a shield against unfair labour practice by employer during pendency of an industrial dispute.
