From the supplier: Hospital liability experts have criticized a Circuit Court of Appeals in Illinois decision permitting hospitals to be sued for refusing to accept patients who have not yet reached the hospital. Hospital officials claim that by the Court's broadening of the Consolidated Omnibus Budget Reconciliation Act (COBRA), they risk being sued for actions that take place out of their domain. COBRA was established in 1985 to prevent hospitals from rejecting or transferring Medicare patients.
