Associations may choose not to waive their right to litigation, which allows them to choose the forum for dispute resolution, the right to a jury trial and use of the rules of discovery. The main advantage of arbitration is that it is usually faster than litigation. Another alternative to arbitration is mediation, in which a mediator makes non-binding recommendations to resolve disputes.
