From the supplier: The Insurance Services Office (ISO) is incorporating an exclusion for an indemnitee's defense costs arising from contractural liability cases in its commercial general liability (CGL) insurance policies that will be issued beginning in 1996. Under contractural liability, a CGL insured assumes the liability of an indemnitee. Several years ago, ISO concluded that its CGL policies do not cover indemnitee's contractural liability defense costs, and the move puts its position into writing. CGL policyholders should check their policies to see if similar provisions are in force.
