From the supplier: The Judicial Conference of the US has proposed that Rule 23 of the Federal Rules of Civil Procedure be revised to allow judges to certify class actions that may not meet the standards for certification for trial. Advocates of the reform note that promoting settlement will reduce costs and that many certification requirements are unnecessary when settlement is anticipated. Critics believe that this reform would promote collusion between corporate defendants and plaintiffs lawyers that would leave injured parties with inadequate settlement funds and no right to trial by jury protection.
