Federal and State Civil Procedure Handbook is intended to serve as a supplement to the basic law school civil procedure course(s), as well as to other civil litigation courses. Like other such supplements, it contains federal procedure and evidence rules and statutes together with federal constitutional provisions relevant to civil litigation in the Article III federal courts. Unlike other supplements, however, it incorporates other crucial materials, including selected provisions from the Model Rules of Professional Conduct, the Restatement of the Law Governing Lawyers, and the Federal Judiciary Act of 1789. Most significantly, it also contains many comparative state law provisions which follow directly the relevant federal rules, statutes and constitutional provisions and which demonstrate how state civil litigation practices may differ from federal civil litigation practices. Finally, it includes selected criminal procedure rules which permit comparisons between civil and criminal litigation.
