English summary: This work presents a systematic presentation of the legal proceedings in civil processes and is conceived as a primer and textbook, which imparts to the user concrete material, especially the more comprehensive information concerning procedural relationships. It deals with the civil process expressly as a formal civil law and in various individual questions bridges substantive law, such as in the lessons concerning procedural goals, the matters in dispute, the so-called forms of complaint, the legal consequences of hearings and the procedural acts. At the same time, this study pulls together summary materials from several authors which provides a rapprochement between the all-too-strictly divided fields of civil law and civil procedure law. Next to those concerns, as a matter of technical law, civil litigation is chiefly presented as one of the pillars of civil law next to proprietary law and contract law.



German description: Das Werk enthält eine systematische Darstellung des zivilprozessualen Erkenntnisverfahrens und ist als Lehr- und Lesebuch konzipiert, das dem Benutzer neben positivem Wissensstoff vor allem die Kenntnis |bergreifender Zusammenhänge vermittelt. Es behandelt den Zivilprozess nachdr|cklich als `Formelles Zivilrecht` und schlägt in vielen Einzelfragen die Br|cke zum materiellen Recht, so etwa in der Lehre von den Prozesszwecken, vom Streitgegenstand, den sogenannten `Klagearten`, der Rechtskraft und den Prozesshandlungen. Damit zieht es zugleich die Summe aus einer von vielen Autoren getragenen Entwicklung, die auf eine Wiederannäherung der allzu strikt auseinander dividierten Gebiete des Zivil- und des Zivilprozessrechts gerichtet ist. Weit davon entfernt, nur `technisches` Recht zu sein, erscheint der Zivilprozess neben dem Eigentum und dem Vertrag als eine der Säulen des Zivilrechts |berhaupt.
