The Fifth Amendment's Takings Clause states that "nor shall private property be taken for public use, without just compensation." The ruling of Kelo turned on the interpretation of the term "public use." The Supreme Court had to decide whether "public use" by a local government went beyond clearly defined public uses such as highways and bridges to encompass a broad concept such as "economic development."

In Kelo the Supreme Court upheld the use of eminent domain by a city to transfer land from a private owner to a developer to further economic development.
