Insurance Company, 4O hio State, 628, 645, to the effect that: If there is anything eminently and exclusively our own, it is our system of legal procedure, expresses the idea of this book. It treats upon all questions of Practice, from the filing of the first pleading, or from the formation of the issues to the termination of the action, in the nisi pritts, and the appellate, or reviewing courts. It deals with matters preliminary, such as The Time of Commencing A ctions, Jurisdiction, Process, c., following which is a discussion of the modes of trial considering all questions relating thereto. Then follows Judgment, Execution and Sale, c., Appeal and Error. The book is named Court Practice, which embraces everything that is or may be done in court from the commencement to the final termination of a cause, and hence comprehends more than is usually understood by Trial Practice.
