Texas Real Estate Contracts has appeared in many editions since 1992. It is widely used both by educators at colleges and real estate schools as well as practicing real estate license holders. A nearly 500 page book is not exactly light reading – due to the nature of their business, practicing brokers are busy and may not have time to read the whole book cover to cover.
The key is to use the book as a reference. In practice, agents may hit a “snag†in their deal due to controversy over a contract paragraph or contract related issue. In these instances, their attention must focus like a laser beam on the problem to get the deal done – that’s where this book pays off.
It’s an ideal TREC contract reference tool, and widely used for just that purpose. When the other broker is writing junk into the forms or otherwise misusing forms – and you know it, or suspect it, you've got this book at your fingertips to resolve the dispute or solve the problem. When you need this kind of information, you need it urgently. Newbies love the book. Experienced agents also love the book for the depth – it often clarifies or re-emphasizes things they sort of recall or instinct warns them about. Confirm your thoughts – fast. For top agents, any good new information they do not already know, even on a minor point, makes the book invaluable. Clients deserve the best.
Attorneys use the book too – there are numerous case citations and pertinent statutes are often included verbatim. You go where you need to go – fast. For example, there are 11 exemptions on using the §5.008 seller’s disclosure. The other side doesn’t want to send it – are they within their rights? Check it out. The book reprints the statute and analyzes the exemptions and their use.
Also, the commentary explains why, even if you qualify for an exemption, you may want to use the disclosure form regardless. It includes an analysis of the new RESPA laws as they affect the November 2, 2015 contract forms. The Broker-Lawyer Committee drafts for the new forms earlier in 2015 included a 10 day extension – they thought it would be needed for the new RESPA law, but later, they thought otherwise and took it out.
Read and see what arguments were made in the Committee meeting to convince them to do that – the three most likely delays under the new closing rules and how to minimize the problem. Lots and lots of depth everywhere. There’s no resource like it – some firms have nicknamed this book, the "Gray Bible."
Of course, for new agents and teaching, it’s a must have. Office managers will sleep better knowing the newbies have the resource – just in case no one’s there to help them when it’s needed.
