The reader may be surprised to find in this work several decisions which are no longer applicable, owing to the changes effected in our laws of Procedure by the Code and its amendments ; but the compiler deemed it expedient to insert them, in order to show at a glance the successive developement of our present laws, and to anticipate, if possible, any future legislative enactments which may bring us back again to the system in force before the promulgation of the Code. Reliance may be placed on the fidelity of the references to the Decisions, as the proof-sheets were corrected from the original volumes of the Reports, and not from the manuscript.
