From the supplier: AIDS activists plan to use provisions of the Americans With Disabilities Act (ADA) to remove employer-sponsored medical plan caps on benefits for AIDS victims. The ADA specifically names AIDS as a covered disability, and overrides the Employee Retirement Income Security Act that permitted self-insured plans to cap AIDS benefits. The ADA provisions, which will be used in an Equal Employment Opportunity Commission test case in Minnesota, is expected to become a standard in benefit cap lawsuits.
