From the supplier: An employer that knowingly accepted payments, for a Consolidated Omnibus Budget Reconciliation Act health insurance plan, from an ineligible former employee has been found liable for that employee's coverage by the 11th Circuit Court. The employee was ineligible because of his wife's insurance, but had a written representation affirming his eligibility. Under equitable estoppel, the Court held the company liable for knowingly misrepresenting the employee's eligibility.
