From the supplier: A subcommittee of the House of Representatives' Energy and Commerce Committee passed a Superfund reform bill that has come under criticism by insurance industry trade associations. The insurance industry objects to the bill because it does not contain a provision encouraging out-of-court settlements by potentially-responsible parties (PRPs) that was contained in earlier drafts. The provision mandates that PRPs pay one-half of the legal fees of insurance companies defending PRPs that rejected a settlement offer in cases where the outcome is less than favorable to the PRPs.
