From the supplier: Hotel rape cases differ from sexual assaults in apartment houses or shopping center parking lots because of the guest's trust that the innkeeper will meet premises liability duties and women's vulnerability in hotels in strange places. Defendants may include such parties as tour operators in addition to hotels. Federal diversity jurisdiction may be available in cases where the plaintiff is from somewhere else, the hotel is owned by a company in another jurisdiction and the rapist is unknown. Factors indicative of negligence and allocation of fault issues are discussed.
