From the supplier: The goal of the new Federal Rules of Civil Procedure is to expedite litigation. Defense law firms may need to change in fundamental ways in order to accommodate the new rules. Procedures such as witness and document evaluation and settlement negotiations will take place very early in a case. Partners will need to become involved at the pretrial stage. Changed case handling will change cash flow expectations, as sustained leveraged profits from billable hours generated by junior lawyers become less likely. The profit decline will lead to higher hourly rates, lower partner income or a shift to value billing. Defense firms must remain flexible to adjust to the new environment.
