From the supplier: The decision of the California Supreme Court in the case of the AIU Insurance Company v. Superior Court was wrong in that it misinterpreted 'damages'. The court decided that waste clean-up costs and compliance costs can be treated as damages. This reasoning ignored the technical connotations of the word. The decision was prompted by public policy and even the public policy assumption underlying the decision was wrong as it held insurers liable for risks that they had never accepted.
