From the supplier: The med-arb hybrid of mediation and arbitration combines afconsensual bargaining phase with a final judgement if an agreement cannot be reached. Though this method is not perfect for all situations, it can provide benefits for appropriate cases in that it is flexible, final, efficient, expedient and private. Participants should be of equal bargaining experience to prevent manipulation, making the technique most appropriate for contract negotiation disputes. Critics are concerned about bias during the mediation phase and the relationship change between mediator and arbitrator.
