From the supplier: State and local governments should be familiar with current salary basis test requirements and pending litigation to avoid lawsuits stemming from violations of overtime pay requirements under the Fair Labor Standards Act. One of the act's key provisions is that employers must pay overtime compensation to employees working over a specified number of hours per workweek, excluding exemptions. Among current requirements of the basis salary test are a weekly predetermined pay, exceptions to weekly pay requirements and other issues such as additional compensation, jury duty, witness time and military leave, window of corrections and improper deductions.
