From the supplier: The appellate court for the third circuit has ruled in a case that an employee's bipolar disorder ought to be determined by considering the condition in its unmedicated state within the context of the Americans with Disabilities Act. The case stemmed from the termination of a female secretary of the principal of an elementary school in Pennsylvania who was fired despite a positive work record. The decision conflicts with rulings by the ninth and 10th circuit appellate courts and remains to be ultimately resolved by the Supreme Court.
