On March 22, 2007, the Occupational Safety and Health Administration (“OSHA”) inspected a construction project in Chicago, Illinois, after four employees of Elliot Construction Corporation (“Elliot”) were exposed to carbon monoxide (“CO”). Following the inspection, OSHA issued Elliot a three-item willful citation alleging violations of the Occupational Safety and Health Act of 1970 (“the Act”), 29 U.S.C. §§ 651-678.
