At issue before the Commission is a serious citation issued by the Occupational Safety and Health Administration (“OSHA”) under the Occupational Safety and Health Act of 1970, 29 U.S.C. §§ 651-678, alleging that Shaw Areva Mox Services, LLC (“Shaw Areva”) failed to ground an electrical adaptor and the plug of a fuel pump cord in violation of 29 C.F.R. § 1926.404(f)(6).1 OSHA issued the citation following an inspection of a worksite in Aiken, South Carolina where Shaw Areva was constructing a nuclear fuel conversion facility.2 The Secretary proposed a penalty of $1,625 for the alleged grounding violation
