This is an action by the Secretary of Labor to enforce a citation issued to the Respondent by the Occupational Safety and Health Administration for the alleged violation of a regulation relating to fall protection in construction work. The matter arose after a compliance officer for the Administration inspected a worksite of the Respondent, concluded that it was in violation of the regulation and recommended that the “willful” citation be issued.
