Trusts are often tested on the bar exam. They can be tested purely as trusts or as a substitute for a will. In the former case you define trusts, types, scope, a trustee’s powers and duties, then address the interrogatory, which will often be about a breach by trustees or a trustee.
If Trusts are tested as a will substitute then treat the trust as if it were a will and talk about pretermitted heirs and spouses, intestacy shares and other relevant Wills issues. But do not treat Wills-only formalities like witnesses because a trust does not need witnesses to be created.
Although Trusts are a huge equity subject, only the basics tend to be tested, so this area of the law should be one of those where you earn a good score.
