From the supplier: The $10 million punitive damages award in TXO Production Corp v. Alliance Resources Corp resulted at least in part from the variety of evidence about the defendant's patterns and practices the court admitted. That evidence's impact on the jury in this case and the frequency of large punitive damage awards generally show how important it is for the defense to fight the admission of this kind of evidence. The defense should investigate evidence of similar conduct at the outset of a case and establish a record of objections which can be used at trial.
