California Army National Guard indicated courts' increasing habit to ignore gay servicemen's 1st Amendment rights when the Court utilized the speech-as-evidence framework. The Court's decision did not provide a faithful constitutional review of the government's rationale for dismissing gay servicemen. Courts must focus on the nonspeech component of the speech act before deciding the nonexistence of a free speech infringement.
