From the supplier: The US 9th Circuit Court of Appeals decision in Holmes v. California Army National Guard indicated courts' increasing habit to ignore gay servicemen's 1st Amendment rights when the Court utilized the speech-as-evidence framework. The Court's decision did not provide a faithful constitutional review of the government's rationale for dismissing gay servicemen. Courts must focus on the nonspeech component of the speech act before deciding the nonexistence of a free speech infringement.
